Last Updated: August 19, 2026

Welcome to Bloomington HIPAA. These Terms of Service ("Terms") govern your use of our website located at bloomingtonhipaa.com and test.bloomingtonhipaa.com (together or individually "Service") operated by Bloomington HIPAA.

1. Agreement to Terms

By registering an account or using our Service, you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these Terms, in whole or in part, you must immediately cease using the Service.

2. SRA Compliance SaaS Product - No Legal or Professional Advice

Our Service includes templates, forms, quizzes, checklists, and self-guided Security Risk Assessments (SRA) (collectively, "Compliance Tools"). You agree and understand that:

  • No Professional Advice: Bloomington HIPAA provides informational self-assessment software. We do not provide legal advice, legal opinions, or certified audit audits. The Service does not replace professional legal counsel or formal consulting.
  • Client Responsibility: You are solely responsible for verifying the accuracy of all assessment answers, policy adoptions, and regulatory compliance actions within your practice. Completing an SRA or training module using our platform does not guarantee compliance under HIPAA, HITECH, or state laws, nor does it guarantee you will pass a federal audit.

3. Web Hosting and ePHI Disclaimer

IMPORTANT SECURITY RESTRICTION:

If you purchase or use our web hosting services:

  • No ePHI Storage: You will NOT store, transmit, or process electronic Protected Health Information (ePHI) in any standard web hosting account provided by Bloomington HIPAA. Standard hosting servers are not configured or audited to store ePHI.
  • Form Security Configuration: To maintain secure practice operations, you must configure any forms on your website using compliant secure methods. You agree to contact us at info@bloomingtonhipaa.com for assistance and guidance on secure database setup.

4. IT Support & Technical Assistance

If your package includes live screen-share or technician assistance (collectively, "IT Support"):

  • Basic Assistance Only: We provide basic remote troubleshooting and security configuration guidance (such as walking you through configuring multi-factor authentication or screen-lock settings).
  • No Managed Security Services (MSSP): We do not act as your managed service provider, internal IT department, or outsourced security operations center. We do not actively monitor your networks, configure firewalls, or manage individual device endpoints.
  • Backups and Loss: You are solely responsible for ensuring your systems, devices, and files are backed up before allowing remote screen-share support. Bloomington HIPAA is not liable for data loss, server downtime, or system incompatibilities arising from support sessions.

5. Limitation of Liability & Warranty Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • As-Is Basis: The Service, including all compliance materials, templates, and IT support, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
  • Liability Cap: In no event shall Bloomington HIPAA, its directors, employees, or partners be liable for any indirect, special, incidental, or consequential damages (including loss of profits, data breach costs, or regulatory fines). Our total liability for any claim arising out of these Terms shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
